Appendixes of seasonal rental contract
Prices
All prices are in Euros, include our agency fees and can be modified without any advance notice, except in instances where the deposit has been paid within 15 days from the date on which the reservation form was sent.
Occupancy tax
To be added to the rental price = 1 Euro/ person/ day
Excluding children under the age of 13, civil servants and state officials temporarily called on duty in the city. People who live in the city and who consequently are liable for council tax are exempt from the occupancy tax too.
Expenses not included in the rent
Electricity, gas, water
Insomuch as HomeMarseille can easily take a reading of the different meters (water, electricity and gas), the tenants have to pay for their consumption regardless of the length of the stay according to the rate below:
Electricity= 0, 10 € all taxes included / kwh
Gas = consumption in m3 x ratio of 11, 53 = consumption in kwh x 0, 05 € all taxes included
Water = 3 € all taxes included/ m3
To be paid on arrival of the tenant to the owner's account.
Cleaning before departure
It is non-negotiable and compulsory.
Optional daily cleaning service (see services)
Bed linen and towels
If you would like to benefit from the sheets and towels option (beds are made):
Double bed = sheets and 2*2 towels 25 Euros/stay
Single bed = sheets and 2 towels 20 Euros/stay
They can be changed by request at this rate.
Expenses included in the rent
TV – internet
HomeMarseille won’t be held responsible for any malfunction of these service providers.
Length of the stay
Generally speaking, the minimum stay is 7 nights. A shorter stay is possible for a last minute reservation or longer in advance if your arrival/departure follows or precedes a stay.
Within the framework of the seasonal rental, your stays cannot last more than 3 months. You won’t be able to establish the rental as your main place of residence, except for some rentals (ask for further details) but the contract would be the same as any standard furnished rental.
Reservation procedure
1) Our availability calendars are up-to-date; however, it is better that you ask us for rates and availability by e-mail or by the rental form via Booking or by phone. Only optional services can not be found on the schedules.
2) To confirm, we will need personal details (name, address…). At the receipt of this information, we will provide you with a reservation form.
A 25% deposit will have to be paid before the date specified on your contract. The balance and the deposit are generally to be paid when you are given the keys except as otherwise stated on your contract. If you wish to send your deposit by cheque, we recommend you do so by registered letter.
3) Your first payment will become the deposit from the instance where we send you an e-mail with the exact address of the rental which will only be released at this specific time.
In case of cancellation on the part of the tenant, the deposit will not be refundable unless you have taken out a cancellation insurance of which HomeMarseille doesn’t offer yet.
Arrival
From Monday to Saturday between 3 pm and 7 pm.
HomeMarseille will welcome you in any of its rentals. Make an appointment the day before your arrival.
If you would like to arrive earlier than 3 pm, it is possible only if there hasn’t been a departure on the day of your arrival. (With no increase of price).
However, you will be charged 30 Euros for a late arrival – after 7 pm or on a Sunday.
Departure
Departures are 7 days a week before 10 am.
Thank you for respecting this time policy as the cleaning is organised according to this schedule.
Most of the time, you will be asked to leave the keys in the rental while closing the door behind you or in the letter box.
You are also asked to fulfill the commitment that you take notice of on arrival (what you have to do before leaving the place is listed on a note. For example: do the dishes and put them away, clean the oven and the microwave, take the trash out…).
If you want to get your deposit back on the day of your departure (except on Sundays or before 9 am), we will need 4 hours to draw up the inventory and state of repair.
Security deposit
The deposit amount appears on the contract or on the rental itemized form and has to be handed over on your arrival at the latest.
You will be able to enter the property only after the deposit is made.
If no damage is noticed on your departure and if you have paid any additional charges (phone consumption, additional charges for the cleaning service, use of more beds than expected, …) the deposit will be restored within a fortnight at the latest after deduction – if necessary- of rental repairs or charges payment and placement fees of 25 Euros for any dispute.
An itemized bill listing all the repairs done and the deducted charges will be sent with an acknowledgement to the tenant.
If you want to get your deposit back on the day of your departure (except on Sundays) we will need 4 hours to draw up the inventory and state of repair.
Deposit payment terms
By non-cashed cheque: it will be sent back to the address given on the cheque.
By transfer payment: the deposit will be rewired to your account (with the deduction of our bank fees).
In cash: the deposit will be sent back – by money order - to the address mentioned on the contract (with the deduction of the money order fees).
By bank card: sent back (with the deduction of the bank card return fees).
Behaviour and appearance required
HomeMarseille cares strongly about adopting a non-discriminatory policy, not refusing to rent a place because of a foreign name, of sexual orientation, of political opinions, of religious or racial affiliations…
Out of respect for the neighbourhood, for the property owner and for HomeMarseille, we also care strongly about the tenants’ behaviour as soon as they arrive (proper attire required) and throughout their stay, the tenants will behave as “role model”. You are not allowed to show up shirtless or dirty for instance.
HomeMarseille will be entitled to refuse the access to a rental if this policy is not respected, without any refund and the rental balance will still have to be paid. HomeMarseille will ask you to leave the rental before the end of the stay if complaints from the neighborhood were to be registered in reference to noise or any other negative behaviour.
Lost property
The tenants will have to pay for the postage to get their forgotten items back.
The keys
2 sets of keys are provided for each of the rentals.
If these are lost, the amount billed by the artisan will be debited from the deposit (the prices may fluctuate considerably according to the type of keys) + 50 EUROS fees.
We always have a third set of keys and if we unfortunately had to come and assist in opening the door, you will have to pay 90 Euros for travel expenses (there will be an increase of 50 Euros if the intervention takes place between 10 pm and 7 am).
Complaints
Any possible complaints concerning the rental will have to be made within the following 48h after entering the rental, by phone, then by registered letter with documentary evidence to HomeMarseille – 197 avenue Pierre Mendès France – 13008 Marseille.
Complaints won’t be taken into account after this time.
It is important to acknowledge and understand that the agency cannot be held responsible for any irregularity concerning the water, electricity, internet, TV or phone services.
Animals
For the sake of hygiene and out of respect for people with allergies, animals are not welcome in any of our rentals.
Do not hesitate to ask us if you want to know about the nearest quality kennels.
If, when you check out, there are hairs or other signs indicating that you brought animals to the rental, we reserve the right to deduct money from the deposit (for the extra cleaning) so as to eliminate every trace of their presence.
Room capacity
The room capacity is limited to the number and names of people mentioned in the contract throughout the entire stay.
If you exceed the number of foretold people in the rental contract without prior agreement, at your arrival or during your stay, we reserve the right to deny access to the rental or to ask for a price increase, according to the real number of occupants.
Bringing extra beds is not allowed. If this rule is not followed, the owner or his/her representative will be able to ask you to leave immediately and ask for a compensation for harm endured. The same can happen for neighbourhood disturbance.
Swimming pool
Responsibility discharge clause.
The access to the swimming pool and its surroundings is exclusively reserved for residents only who are fully responsible. Swimming is strictly FORBIDDEN to unaccompanied children under 18.
The swimming pools are equipped and meet all security requirements. Residents are responsible for the setting up of the system and its smooth functioning.
HomeMarseille’s obligations
State of repair
A detailed inventory (or state of repair) is free to access in the rental. You need to take cognisance of it as soon as you arrive. It also includes a note about things you need to know in order to make the most of your stay and about points you need to respect when checking out (doing the dishes, taking out the trash…).
At your request the inventory will be made line by line. In most cases, you will have 24h to protest by texts or e-mails.
If there is no dispute, we understand that you agree with the inventory and state of repair and any difference at your departure will be the subject of a compensation request.
Any lost, broken or damaged objects will have to be replaced or the cost of a replacement will have to be incurred by the tenants.
It is forbidden to throw away objects which are likely to obstruct, or detergent products which could damage the facilities or the pipes in the sinks, toilets, bathtubs or any other sanitary equipment.
In case of damage, the tenant would be indebted for the costs brought on by the rehabilitation of the facilities.
Additional services
HomeMarseille is at your disposal to help you organise your stay (visits, boat rentals, reservations for shows or restaurants, sports…) and can provide services such as cooking meals, baby-sitting… Check out the services section on www.HomeMarseille.com
Insurance
It is compulsory that the responsible person in the rental presents themselves with a copy of their holiday home insurance for the concerned rental.
If you don’t have any, we will compulsorily have to take out an insurance contract via our agency. You should expect to pay between 30 and 50 Euros per rental.
Smokers
Smoking is not allowed inside the rentals.
If we can smell that you have been smoking inside the rental, HomeMarseille reserve the right to deduct money from the deposit (for the extra cleaning) so as to eliminate the smell.
Children
Some of our rentals may be dangerous for children who are not under strict surveillance (large balconies, staircases, duplex apartments…) HomeMarseille will advise you about them at your arrival.
Children must be under constant surveillance from their parents or legal guardians who pledge not to sue HomeMarseille and/or the property owner in case of serious or minor accidents/injuries.

Cancellation by the tenant
Your cancellation must be in writing: by e-mail or by registered letter to the head office of HomeMarseille. The date of receipt is binding. You will lose your deposit; we recommend that you take out a cancellation insurance (on your own, as HomeMarseille doesn’t offer any yet).
If you are not present at the agreed time, the rental will be available to rent by someone else after 12 hours.
If you had to leave the rental earlier than expected, you will not be refunded.
For stays longer than 3 months, the departure conditions are different.
Cancellation – change from HomeMarseille
You will be notified as soon as possible if HomeMarseille has to make any change or cancel the rental specified in the booking confirmation and we will try to offer you the nearest alternative choice from first contract. In case of upgrading, HomeMarseille will not demand any additional charge.
If you are not happy with the solution, we will give you a refund on all the sums already paid.
Legal regime and contract term
The rental is under French law and is concluded as a temporary holiday residence.
The lease is terminated at the end of the rental period of which the date is set on the rental contract.
You are not permitted to rent the place longer without prior written agreement from HomeMarseille. The residential units cannot be used as a main residence nor as a holiday home and the tenant is not allowed to exercise commercial, professional or any other activities.
Consequently, rental contracts will be ruled by the civil code clauses and by the conditions provided for by the present mandate.
These present general conditions apply failing opposite, different or additional specification in the particular conditions.
In case of dispute, the parties involved elect domicile at the address mentioned on the rental contract.

Rare events (weddings, parties, receptions…) are subjected to HomeMarseille’s prior agreement.
Forbidden tenants
For their own security, unaccompanied (24/7) persons under 18 and unaccompanied persons placed in the care of a guardian are not accepted.
